Is mould the landlord's responsibility in the UK?+
In almost all cases, yes. Section 11 of the Landlord and Tenant Act 1985 and the Homes (Fitness for Human Habitation) Act 2018 make landlords responsible for the structure, exterior, ventilation provision and overall fitness of the property. Tenants are only liable where the cause is genuinely behavioural and the building's ventilation and insulation are otherwise adequate.
Does Awaab's Law apply to private landlords?+
Awaab's Law came into force in October 2025 for social landlords in England. The Renters' Rights Bill is expected to extend equivalent obligations to private landlords. Even before the legislation lands, private landlords should treat the 14-day investigation, 7-day emergency repair and 28-day non-emergency repair timescales as best practice — local authorities already enforce against damp and mould under HHSRS.
What happens if I ignore a tenant's mould complaint?+
Ignoring a written mould complaint exposes you to civil penalties of up to £30,000 per offence under HHSRS, Rent Repayment Orders of up to 12 months' rent, banning orders, disrepair claims under Section 11, and personal injury claims under the Defective Premises Act 1972. The cheapest defensive step is acknowledging the complaint in writing within 14 days and commissioning an independent HHSRS-compliant survey.
Can a tenant sue a landlord for mould?+
Yes. Tenants can bring a disrepair claim under Section 11 of the Landlord and Tenant Act 1985 or under the Homes (Fitness for Human Habitation) Act 2018, plus personal injury claims for health harm. Most claims are run on a no-win-no-fee basis. Successful claims typically result in damages plus a court order requiring the landlord to carry out the necessary repairs.
What does an HHSRS-compliant mould survey include?+
An HHSRS-compliant survey identifies and rates each of the 29 statutory hazards relevant to the property, with particular focus on hazard 1 (damp & mould). It includes moisture readings, thermal imaging, photographic evidence, identification of the underlying moisture source, a Category 1 / Category 2 hazard rating, and a prioritised remediation plan. The format is the documentation environmental health, courts, ombudsmen and insurers expect to see.
