Where mould stems from disrepair, inadequate ventilation or a structural defect, responsibility sits with the landlord under Section 11 of the Landlord and Tenant Act 1985 and the Homes (Fitness for Human Habitation) Act 2018. Students are only responsible for reasonable everyday ventilation, which an HMO must be physically able to support.
